The excitement of the occasion has long been an attraction to sell and buy at auction, as well as the knowledge that on the fall of the hammer, a contract is secured.

Our auctioneers are all valuers and our local knowledge is invaluable in assessing not only the market but also the equipment and detail necessary to make the day a success. Many of our auctions are run simultaneously on-line, to ensure we capture as wide an audience as possible.

We adapt to manage small sales as well as large ones, and work with clients to enable the best possible outcome, from turning the idea of a small personal sale into a collective sale by drawing in other equipment from the locality or making a single seller auction a sucess in its own right.

It is vital to plan a sale with every eventuality in mind, from weather to car parking, and we spend as much time as necessary to organise the process.

The process includes:

  • Valuation of equipment for sale purchase or for tax purposes
  • Advice on the most appropriate method of sale
  • Advice about the location and timing for the sale
  • Advice about the site and how to conduct the sale
  • Management of the auction day to ensure the best possible outcome
  • Effective collection and prompt distribution of sale proceeds

General guidelines for buyers and sellers.

BUYERS’ GUIDE

All potential purchasers must register with the Auctioneers and complete a Buyer’s Number Slip and be allocated a Buyer’s Number. Bids may not be accepted without a Buyer’s Number. To do so please contact us by telephone or email before the sale date. Buyers can collect their bidding numbers from reception on the day of the sale and will need to leave their passport, ID card and a refundable deposit of 1.000 PLN as security.

Payment

All lots become the sole risk of the purchaser at the fall of the hammer. The property in a lot purchased shall not pass to the purchaser or be removed until payment has been cleared of the full purchase price (including commission and VAT) to the auctioneers. All buyers must either pay in full on the day or leave a 10% deposit. All payments are to be made in the Polish currency (PLN). Accepted methods of payment include bank guarantee, credit card or cash.

Deposit

All buyers will need to either pay in full on the day of the sale or leave a 10% deposit.

Removal of Lots

No lots may be removed from site unless accompanied by a receipted invoice. All lots are to be removed with 7 days.

Loading Facilities

Loading facilities will be available on sale day. Any lots remaining after the removal date will be re-sold. The Joint Auctioneers and Vendor will not accept any responsibility or liability for the loss or damage to lots left on the sale ground and all purchasers are reminded that they are entirely responsible for any lot purchased from the fall of the hammer.

Buyer’s Premium

A Buyer’s premium of 2,5% will be added to the hammer price and payable on all lots. This is subject to VAT at 23%.

VAT

VAT will be payable on all lots in addition to the hammer price at the standard rate.

Conditions

The sale will be conducted under our standard Conditions of Sale. All prospective purchasers should ensure that they have read and understood those Conditions. The act of bidding will be taken as acceptance of them and contracts will be required to be signed before receiving a buyers number.

Commission Bids

The Auctioneers will be pleased to take written commission bids prior to the sale. Forms are available on request.

Engine Hours

Neither the vendors nor the auctioneers make any warranty regarding engine hours or vehicles mileages.

Catalogue Entries

Whilst every attempt is made to ensure that the descriptions are accurate, no guarantees are either given or implied. Buyers should be aware that from time to time, lots are withdrawn and other lots added. Please contact the auctioneers prior to the sale to ensure that the machinery has been delivered onto the sale ground and to get your copy of the catalogue.

Lots may be viewed on Friday 10th June, please contact the auctioneers to arrange. We look forward to seeing you at the sale but please ensure that you register with us beforehand. Entries must be delivered to the sale field 24 hours prior to the sale. No lots can be accepted after this time. Brown & Co reserve the right to refuse entries considered unsuitable for the sale.

Loss or Damage

Security will be provided at the site. We accept no liability whatsoever in respect of loss or damage to any machine or article entered for sale.

Entry Fee

A non- refundable Entry Fee will be charged on entry of lots with a Reserve price. This will vary depending on lot value.

Commission

Our commission plus VAT will be deducted from the proceeds of sale. For sellers, commission will be charged between 5% to 10% depending on the lot size plus VAT.

Lot Removal

In the event of an entry not being sold, you will be notified after the sale. We accept no responsibility for the loss or damage of lots whilst on the site.

A copy of our full conditions of sale is required to be signed.

We will not offer for sale any articles subject to the conditions of a lease agreement.

Value Added Tax

VAT Registered sellers will be required to issue an invoice to the auctioneer using the relevant VAT rate. The auctioneer will remit funds to the seller, minus the sales commission (plus VAT) within 21 days following the date of auction. The auctioneer will then provide to the seller an invoice for commission plus VAT. Vendor’s commission is subject to VAT at the prevailing rate.

Payment

All payments must be made in Polish Zloty (Pln) as this is the currency in which the auction will be held. Accepted methods of payment are cash or electronic bank transfer. The proceeds of the sale will be paid over to you within 21 days following the sale. Invoices meeting the Polish tax regulations must be received in original form before funds are transferred. For sellers domiciled outside Poland please contact us for individual arrangements.
